Before proceeding to payment, please read and agree to this Rental Agreement. By proceeding with a booking you confirm that you have read, understood, and agreed to this Rental Agreement. This agreement is legally binding and governs your stay.
01Acknowledgement
By proceeding with a booking, you acknowledge that this Rental Agreement constitutes the entire agreement between the guest and the host.
02Cancellation policy
- 50% refund for cancellations made more than 30 days before check-in.
- No refunds for cancellations made within 30 days of check-in.
- No-shows are not eligible for a refund.
03Card on file
By proceeding with this booking, you authorize Stay Cape Ann to charge the payment method on file for damages, additional cleaning, policy violations, or other fees described in this agreement.
Charges may be assessed during or after your stay. The host will notify you of any charge with supporting evidence within 10 days of check-out.
Charges may include:
- Damages to the property or its contents.
- Additional cleaning required beyond standard turnover.
- Fees for unauthorized guests, pets, or late check-outs.
- Any other violations of this Rental Agreement.
04Access and occupancy limits
Access to the property is limited to the number of guests specified in the booking. Unauthorized guests are strictly prohibited. The guest responsible for the booking must provide a complete list of all occupants before check-in.
- Any unauthorized guest will result in an immediate fee of $200 per guest per night, charged to the payment method on file.
- The presence of unauthorized guests may result in immediate termination of the booking without refund.
- In cases of severe violations, local law enforcement may be contacted.
05Check-in and check-out times
- Check-in: 4:00 PM
- Check-out: 11:00 AM
Early check-in and late check-out requests may be accommodated based on availability for an additional fee. Guests must contact the host in advance to arrange this.
Fees for non-compliance:
Late departures or early arrivals without prior approval will incur a $100 per hour fee. If such delays disrupt subsequent guests, additional fees may be applied, including covering alternative accommodations for affected guests.
These timeframes are necessary to allow our housekeeping and maintenance teams sufficient time to prepare the property to the highest standard for incoming guests.
06Quiet hours
- Quiet hours are observed from 11:00 PM to 7:00 AM daily.
- During this time, guests are asked to avoid any activities that may disturb neighbors or violate local noise ordinances. This includes loud conversations, amplified music, or any other excessive noise.
- Use of outdoor spaces, including patios, decks, and balconies, should be limited during quiet hours to minimize noise disruptions.
- Any complaints from neighbors or reports of excessive noise during quiet hours will be taken seriously, with potential violations resulting in fines or termination of the booking without a refund for repeated or severe violations.
07Chargebacks and disputes
All disputes must be addressed directly with the host before initiating a chargeback. Unauthorized chargebacks incur a $50 administrative fee.
08Safety and security
Guests are responsible for securing the property. The host is not liable for lost or stolen items.
09Pet policy
Pets are not permitted unless explicitly approved in writing before the stay. Fees may apply due to the additional cleaning necessary.
10Damage and reporting
Guests must report damages immediately. Costs for repair or replacement will be billed with evidence provided.
11Limitation of liability
The host is not liable for events beyond their control, including but not limited to natural disasters, power outages, extreme weather, or emergencies. Guests are strongly encouraged to purchase travel insurance for coverage in such situations.
12Entire agreement
This Rental Agreement constitutes the entire understanding between the guest and the host. Any changes or modifications must be agreed upon in writing.
