These terms apply when you use staycapeann.com or book a stay through it. Please read them. By using the site or completing a booking you agree to them.
Who we are
Stay Cape Ann is operated by Rising Tide Short Term Rentals (“we,” “us”), based in Gloucester, Massachusetts.
Bookings
When you complete a booking you enter into a reservation agreement with the property owner, with us acting as their manager. Your reservation is confirmed only once payment has been processed and you have received a confirmation email with a confirmation code.
You must be at least 25 years old to book, be present during the stay, and provide accurate guest information. Parties, events, and unregistered guests are not permitted.
Payment
Payment is due at the time of booking and processed by Stripe. Listed prices include cleaning fees and taxes where indicated. Additional fees may apply for extra guests, pets, or damages.
Cancellation
Our cancellation policy is the same for every home:
- More than 30 days before check-in: 50% refund.
- Within 30 days of check-in: no refund.
- No-shows are not eligible for a refund.
We strongly recommend travel insurance. The full terms that govern each stay are in our Rental Agreement, which you confirm at checkout.
House rules
Each home has its own rules covering occupancy, pets, smoking, and quiet hours. You will see the rules before booking and again in your confirmation. Violations may result in early termination of your stay without refund.
Damages
Guests are responsible for any damage to the property or its contents beyond normal wear and tear. We may charge the payment method on file for documented damages.
Liability
We do our best to describe each home accurately. Photos and descriptions are our good-faith representation at the time of publication. We are not liable for circumstances outside our reasonable control, including weather, utility outages, or acts of nature. Our total liability is limited to the amount you paid for your reservation.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute will be resolved in the state or federal courts sitting in Essex County, Massachusetts.
Changes
We may update these terms from time to time. The updated version applies to bookings made after the “last updated” date above. Your existing reservation is governed by the terms in effect when you booked.
